JDEN Services - Spider Cage, Ability or Universal Exercise Unit - Two-Day Comprehensive Course - 01.09.2025
 

1)    Parties
a)    These Terms and Conditions (“Terms”) form a legally binding agreement between:

i)    JDEN Services, of Suite 210, 4/33 Windsor Road, Kellyville NSW 2155, Australia, admin@jdenservices.com.au (“JDEN Services”), acting as the facilitator of the Course in Australia; and
ii)    PediaSuit LLC, 16400 Sapphire Drive, Weston, FL 33331, USA, info@pediasuit.com, (“PediaSuit”), acting as the training provider; and
iii)    The enrolling participant (“Participant”).

2)    Course Description

a)    The “Spider Cage, Ability or Universal Exercise Unit” is a Two-Day Comprehensive Course aimed at Occupational, Paediatric Therapists, and Physiotherapists who provide treatment to patients with disabilities and includes practical and theoretical components on the use of the Spider Cage, Ability or Universal Exercise Unit for therapeutic applications.
b)    Training is delivered in person on the two designated days, at the selected location commencing at 8:30 am and concluding at 4:30 pm (local time), with breaks as per the outline. Participants must arrive on time and attend all sessions. Late arrival or early departure may result in incomplete certification.
c)    JDEN Services reserves the right to relocate the training to an alternative location.
d)    The Course outline, inclusions, and learning outcomes are available from JDEN Services upon request.

3)    Enrolment and Fees

a)    The total Course fee is as advertised (inclusive of GST), covering tuition, materials, and certification. Fees are non-negotiable; the course fee does not cover the costs of travel, accommodation or meals.
b)    To register for the Course, the Participant must:

i)    complete the registration process in the manner directed by JDEN Services; and
ii)    agree to these Terms; and
iii)    make full payment of the course fees at the time of enrolment.

c)    Enrolment is not confirmed until full payment is received and acknowledged by JDEN Services.
d)    All fees are stated in Australian Dollars (AUD) and are inclusive of GST unless otherwise specified.
e)    By completing the registration process, including submission of the enrolment form and full payment of the Course fees, the Participant agree to be bound by these Terms. If you do not agree to these Terms, you must not register for or participate in the Course.
f)    JDEN Services reserves the right to cancel, postpone, or change the dates of any Course where the total number of confirmed Participants is fewer than ten (12). In such circumstances, all existing enrolments will automatically transfer to the new Course date once confirmed. Any enrolment fees already paid will be applied in full toward the rescheduled Course date. Where a Participant is unable to attend the rescheduled Course, they may request a full refund by providing written notice to JDEN Services within seven (7) days of being notified of the new Course date.

4)    Cancellations and Refunds

a)    Cancellations must be notified in writing to admin@jdenservices.com.au.
b)    Refund entitlements:

i)    If cancellation is made more than 45 days before the Course start date: 90% of the fees will be refunded (10% forfeited). 
ii)    If cancellation is made within 15 days before the Course start date: 40% of the fees will be refunded (60% forfeited).
iii)    If the Participant does not attend (“no show”): no refund will be payable.
iv)    JDEN Services reserves the right to cancel or reschedule a Course due to insufficient enrolments, trainer illness, force majeure events, or other circumstances beyond its reasonable control. In such cases, Participants will be offered either a full refund or a transfer to a rescheduled date.

5)    Substitution of Participants

a)    Substitution of a Participant may be permitted at no additional cost, provided that written notice is given to JDEN Services at least five (5) business days before the Course start date, and the substitute Participant meets the Course eligibility requirements.

6)    Participant Obligations

a)    Participants must:

i)    attend the Course in full and participate actively.
ii)    comply with all health, safety, and venue requirements.
iii)    behave in a professional and respectful manner towards trainers, staff, and other participants.
iv)    JDEN Services reserves the right to exclude any Participant whose behaviour is disruptive, unsafe, or otherwise unacceptable. No refund will be provided in such cases.

7)    Intellectual Property

a)    All course materials, content, training methodologies, and intellectual property provided during the Course remain the property of JDEN Services, PediaSuit, and/or their licensors.
b)    Course materials are provided solely for the Participant’s personal professional development and may not be copied, reproduced, distributed, or used for commercial training purposes without prior written consent.

8)    Disclaimer and Limitation of Liability

a)    The Course is provided for professional development and educational purposes only. It is not a substitute for independent clinical judgement or professional accreditation.
b)    To the maximum extent permitted by law, JDEN Services and PediaSuit disclaim liability for any loss, injury, or damage suffered by Participants arising from attendance or reliance on the Course content.
c)    You are responsible for your own professional indemnity and public liability insurance. JDEN Services and PediaSuit do not provide insurance coverage for Participants.
d)    Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

9)    Privacy

a)    Personal information collected during enrolment will be handled in accordance with JDEN Services’ Privacy Policy outlined on our website.
b)    By enrolling, the Participant consents to JDEN Services sharing enrolment details with PediaSuit for course delivery and administration.

10)    Governing Law and Jurisdiction

a)    These Terms are governed by the laws of New South Wales, Australia.
b)    The parties submit to the exclusive jurisdiction of the courts of New South Wales.

11)    Entire Agreement

a)    These Terms constitute the entire agreement between JDEN Services, PediaSuit, and the Participant in relation to enrolment in the Course.
